The author explains Michael Oakeshott's distinctive theory of law through an explanation of its notion of authority. He explains the view that modern states are ambiguous, consisting partly of civil associations and partly of enterprise associations. Authority is not a function of people's attitudes to those in power, but exists when a government's action is itself accepted as sufficient reason for unconditional obedience. Authority in this sense cannot exist in enterprise association, commitment to which must be contingent on the fulfillment (...) of purposes common to all participants. But modern states are compulsory associations, different from each. Furthermore, authority could never be justified on a rational choice model, which must always be teleological in character. Because this means there can be no solution to the problem of political obligation, all philosophy can do is describe abstractly the Rule of Law state which does reconcile authority and liberty. In the recent philosophical literature on inquiry, epistemologists point out that their subject has often begun at the point at which you already have your evidence and then focussed on identifying the beliefs for which that evidence provides justification. But we are not mere passive recipients of evidence. While some comes to us unbidden, we often actively collect it. This has long been recognised, but typically epistemologists have taken the norms that govern inquiry to be practical, not epistemic. The recent (...) literature challenges this assumption and uncovers a rich range of questions about the epistemic normativity of inquiry. In this paper, I approach these questions from the formal side of epistemology. Developing out of the philosophy of science, as it did, this branch of epistemology has long discussed inquiry. And, building on the insights of Janina Hosiasson (1931), David Blackwell (1951), and I. J. Good (1967), it has produced a reasonably well-developed framework in which to understand norms of inquiry, both epistemic and practical. In the first half of the paper, I will present the pragmatic versions of this framework due to Hosiasson, Blackwell, and Good, and the epistemic version due to Graham Oddie (1997); in the second half of the paper, I put this framework to work, turning to some of the questions from the recent debate about inquiry and asking how the framework can help us answer them. Questions will include: When should we initiate an inquiry, when should we continue it, when should we conclude it, and when should we reopen it? How should we understand Julia Staffel's distinction between transitional attitudes and terminal attitudes (Staffel 2021a,b)? How do epistemic norms of inquiry relate to epistemic norms of belief or credence, and can they conflict (Friedman 2020)? And how should we understand the epistemic error that occurs when someone is resistant to evidence (Simion 2023)? (shrink)

Religious violence may trigger feelings of repulsion and indignation, especially in a society that encourages toleration and respect, but rejection contradicts the principles of inclusion that define a democracy and its core moral values. How can we think ethically about religious violence and terrorism, especially in the wake of such atrocities as 9/11? Known for his skillful interrogation of ethical issues as they pertain to religion, politics, and culture, Richard B. Miller returns to the basic tenets of liberalism to (...) divine an ethical response to religious extremism. He questions how we should think about the claims and aspirations of political religions, especially when they conflict so deeply with liberal norms and practices, and he suggests how liberal critics can speak confidently in ways that respect cultural and religious difference. Individuals with body integrity identity disorder seek to address a non-delusional incongruity between their body image and their physical embodiment, sometimes via the surgical amputation of healthy body parts. Opponents to the provision of therapeutic healthy-limb amputation in cases of BIID make appeals to the envisioned harms that such an intervention would cause, harms such as the creation of a lifelong physical disability where none existed before. However, this concept of harm is often based on a normative biomedical model of (...) health and disability, a model which conflates amputation with impairment, and impairment with a disability. This article challenges the prima facie harms assumed to be inherent in limb amputation and argues in favour of a potential treatment option for those with BIID. To do this, it employs the social model of disability as a means to separate the concept of impairment and disability and thereby separate the acute and chronic harms of the practice of therapeutic healthy-limb amputation. It will then argue that provided sufficient measures are put in place to ensure that those with atypical bodily constructions are not disadvantaged, the chronic harms of elective amputation would cease to be. Opponents of the provision of therapeutic, healthy limb amputation in Body Integrity Identity Disorder cases argue that such surgeries stand in contrast to the goal of medical practice – that of health restoration and maintenance. This paper refutes such a conclusion via an appeal to the nuanced and reflective model of health proposed by Georges Canguilhem. The paper examines the conceptual entanglement of the statistically common with the normatively desirable, arguing that a healthy body can take multiple forms, including that (...) of an amputee, provided that such a form enables the continuing ability to initiate new norms of existence. It concludes that the practice of healthy limb amputation in cases of Body Integrity Identity Disorder is not only compatible with the goal of medicine but is potentially the only method of achieving this goal in the face of a complex and often mischaracterized disorder. This paper critically assesses three claims on behalf of the Iraq war made by the Bush administration and by various defenders of the war. Then it steps back from the specifics of these three rationales to ask whether they are in fact of the same sort.

Interventions are medically necessary when they are vital in achieving the goal of medicine. However, with varying perspectives comes varying views on what interventions are (un)necessary and, thus, what potential treatment options are available for those suffering from the myriad of conditions, pathologies and disorders afflicting humanity. Medical necessity's teleological nature is perhaps best illustrated in cases where there is debate over using contentious medical interventions as a last resort. For example, whether it is appropriate for those suffering from body (...) integrity dysphoria to receive healthy limb amputations. This paper explores how one's perception of medicine's goal underpins whether interventions are necessary or unnecessary, using the controversial topic of therapeutic amputation as an example. By contrasting ‘classical’ amputations with their more contentious counterparts, it highlights how the idea of medical necessity influences and restrains clinical decision-making. The paper starts by giving an account of body integrity dysphoria, focusing on the debate concerning elective amputation's justifiability. It then introduces Georges Canguilhem's vitalist theory of health, paying particular attention to his emphasis on adaptability. Then, this paper uses his theory as a lens through which to evaluate the appropriateness of therapeutic amputation as a medically necessary procedure. Ultimately, the paper highlights how the label of medical necessity is withheld from potential therapeutic interventions because they fail to conform to pre-established ideas of medicine's purpose and that by doing so, potential harm befalls those who are left with no effective treatments and must look for solutions in the non-clinical world. The study of Borel equivalence relations under Borel reducibility has developed into an important area of descriptive set theory. The dichotomies of Silver [20] and Harrington, Kechris and Louveau [6] show that with respect to Borel reducibility, any Borel equivalence relation strictly above equality on ω is above equality on , the power set of ω, and any Borel equivalence relation strictly above equality on the reals is above equality modulo finite on . In this article we examine the effective (...) content of these and related results by studying effectively Borel equivalence relations under effectively Borel reducibility. The resulting structure is complex, even for equivalence relations with finitely many equivalence classes. However use of Kleene’s O as a parameter is sufficient to restore the picture from the noneffective setting. A key lemma is that of the existence of two effectively Borel sets of reals, neither of which contains the range of the other under any effectively Borel function; the proof of this result applies Barwise compactness to a deep theorem of Harrington establishing for any recursive ordinal α the existence of singletons whose α-jumps are Turing incomparable. We study the structure of Σ11 equivalence relations on hyperarithmetical subsets of ω under reducibilities given by hyperarithmetical or computable functions, called h-reducibility and FF-reducibility, respectively. We show that the structure is rich even when one fixes the number of properly equation imagei.e., Σ11 but not equation image equivalence classes. We also show the existence of incomparable Σ11 equivalence relations that are complete as subsets of ω × ω with respect to the corresponding reducibility on sets. We study complete Σ11 (...) equivalence relations and show that existence of infinitely many properly Σ11 equivalence classes that are complete as Σ11 sets is necessary but not sufficient for a relation to be complete in the context of Σ11 equivalence relations.
